APEX TRADES Inc. (“APEX”, “we” or “our”), has adopted this privacy policy (the “Policy”) to set out the parameters within which personal information that you (“you” or “your”) might share with us will be protected when you access the www.apextrades.ca site (the “Site”) and when the Site is used. It manages the collection, management and disclosure of information that you may share with APEX through your interaction with the Site. It also covers your sharing of information with APEX through your participation in APEX’s promotional activities.
BY ACCESSING THE SITE, YOU CONFIRM THAT YOU HAVE READ AND UNDERSTAND THE POLICY AND ITS CONTENTS.
1. THE INFORMATION THAT WE COLLECT
1.1. Personal Information
In different places on the Site, in particular when you sign up for the Newsletter, or when you request information, we may ask you to share personal information with us. Under the Policy, Personal Information is information that could identify you: your name, your email address, you home or business address and/or your phone numbers. Please note that you will know when we are collecting Personal Information, because you will always be providing it voluntarily.
1.2. Non-personal Information
We also use the Site to compile information that is not of a personal nature (“Non- personal Information”), that is to say information that cannot be used to identify you or to contact you. This is demographic information (for instance your age, gender, occupation or postal code), or factual information such as the Web site you visited immediately before you visited the Site or that you intend to visit immediately after, as well as any other type of anonymous information peripheral to the Site. Non-personal Information can also include information that you provide to us through the use of the Site, such as your preferences in terms of the products on the Site.
2. HOW WE USE THE INFORMATION WE COLLECT
We compile Personal Information in order to enable us to contact you; that way we can let you know about the range of products we market from time to time, as well as, in more general terms, the activities of APEX and its affiliated companies. Personal Information also enables us to respond to your comments or questions. Non-personal Information is used to help us target our clients, to get to know them better, and to be in a position to meet their expectations. That information is intended to improve our offer of products, our marketing, our promotional offers and, in general, our Site.
3. YOUR CONSENT
In consulting and using the Site, you commit to APEX to comply with it and the terms and conditions of the Policy. In so doing, you authorize APEX to retain Personal Information as well as any Non-personal Information you have shared. You will have the opportunity to subscribe to our electronic bulletin for information and updates on our products, APEX and its affiliated companies. You will also be able to terminate your subscription, in which case we will make every reasonable effort to promptly cease our transmissions to you.
4. THE USE OF COOKIES
We will use cookies to collect and retain information in order to improve your experience with the Site. This collection will focus on data such as your domain address or name, your operating system or browser type. The aim is to identify which pages you visit so that we can determine which information is of most interest to you. Ultimately, this will enable us to share with you any information that could interest you.
5. SECURITY OF THE INFORMATION WE COLLECT
Protecting your Personal Information is important to us. We have set in place security systems to protect against the loss, disclosure, unauthorized use or manipulation of your Personal Information. Those systems meet industry standards on privacy.
However, there is always a risk associated with operating databases and transmitting information electronically: there is always a risk of error and privacy system failures. As a result, we cannot guarantee the security of our database. Nor can we guarantee the security of any information you submit electronically. As well, you should bear in mind that it is your responsibility to protect your access codes to the Site, and any information you choose to post to the Site will be accessible to anyone using the Internet.
6. DISCLOSURE OF INFORMATION TO THIRD PARTIES
6.1 Rule
Subject to any provision to the contrary in the Policy, we do not pass Personal Information provided to us on to third parties. However, we reserve the right to use and disclose any Non-personal Information at our discretion.
6.2 Corporate reorganization
As part of its operations, APEX may purchase, sell or merge operating units. In such cases, any Personal Information and any Non-personal Information in our possession or in that of other companies may be transferred as a result of that transaction. Notwithstanding the preceding, Personal Information and Non-personal Information thus transferred will continue to be subject to the Policy or to any other policy applicable to APEX.
6.3 Service providers
We occasionally use the services of external agents to assist with the execution of certain specific services. For instance, such services may be used to set up and monitor promotional campaigns, in which cases those agents will be in charge of managing information and handling data. In those cases, we may share your Personal Information with such third parties. By participating in our promotional campaigns and any other type of activity involving your interaction with us, you are presumed to consent to the sharing of your Personal Information with such third parties. Notwithstanding the preceding, our agents remain at all times bound by confidentiality agreements protecting your Personal Information and Non-personal Information.
6.4 Affiliated companies
We may share your Personal Information with organizations under our control (subsidiaries), that control us (parent corporation), or along with which we are under the control of a third party, where one of them can offer you products that may interest you.
6.5 Disclosure under specific circumstances
We may have to disclose your Personal Information as required, requested or ordered by a court of competent jurisdiction, a government authority or as otherwise required by law. We may also disclose such information in the event that we believe in good faith that such disclosure is necessary or desirable as an example in order to prevent or put an end to a fraudulent situation.
6.6 Express consent
In any other situation that is not addressed under this Policy, we undertake to obtain your consent to share your Personal Information with third parties.
7. LINKS TO EXTERNAL SITES
The Site may on occasion contain links to sites that are not managed by APEX or one of its affiliated companies. The Policy does not apply to such sites, which are not overseen by APEX, which provides no guarantees and assumes no responsibility in such cases. For your protection, we refer you to the policies that may govern such sites. Finally, the presence of such links on the Site does not represent an endorsement of such sites by APEX.
